Frequency Discounts/Multiple Insertion Rates

Rates will be determined by the number of insertions ordered and used by advertisers during a 12-month period. An advertising contract must be on file with the Texas Thoroughbred Association. For 3- or 6-time contracted advertisers who do not supply new copy or artwork by the published deadlines, the preceding scheduled ad may be inserted.

Editorial Policy

The Texas Thoroughbred and TTA Express reserves the right to refuse any editorial copy or advertisements that it deems inappropriate. Additionally, any opinions expressed in articles or letters printed in The Texas Thoroughbred are those of the author’s alone and do not necessarily represent the position taken by The Texas Thoroughbred or the Texas Thoroughbred Association on the subject matter therein.

Ad Proofs

All advertisers will receive a proof of their ad via fax, e-mail or over the Internet; whichever method is preferred by advertiser. It is the responsibility of the advertiser to review the proof and instruct The Texas Thoroughbred of any changes or corrections by the deadline accompanying the proof. The Texas Thoroughbred cannot guarantee corrections or changes received after said deadline.

The Texas Thoroughbred Advertising Policies

  1. The publisher does not recognize verbal agreements. Space reservations and changes are required in writing by closing date.
  2. Advertiser assumes responsibility for providing advertising material prior to established deadline date. If advertising material is not received by this date, publisher will use previously run material when able.
  3. All advertising is accepted only upon representation of the advertising agency and the advertiser that each of them is authorized to publish the entire content of the advertisement, respects property and privacy rights, and that the advertiser has the right to, and is capable of, selling or providing, timely, the product or service advertised at the price advertised. In consideration for publication of an advertisement, the advertiser and advertising agency, jointly and severally, agree to indemnify and save harmless The Texas Thoroughbred and staff members against any loss, liability, and expense, including reasonable attorney fees, incurred by reason of any claim that may arise out of publication of such advertisement.
  4. All advertising claims or assertions must be supported by documentary evidence, and if put in question by The Texas Thoroughbred, the burden of proof rests with the advertiser and his agent. The Texas Thoroughbred relies on statistics furnished by The Jockey Club Information Systems for verification.
  5. All advertising contracts are accepted subject to the terms and provisions of the current rate card, and no waiver or modification is binding upon The Texas Thoroughbred unless in writing and approved by the Editor.
  6. The Texas Thoroughbred shall be subject to no liability for failure to publish or circulate any advertising because of accidents, fires, work stoppages, dilatory postal delivery, acts of God, or other circumstances beyond the control of The Texas Thoroughbred. If, for any other reason, an advertisement is not published, the TTA’s liability shall be limited to return or release of the applicable advertising charge, and in no event shall TTA be liable for consequential damages.
  7. All advertising must be clearly identified as such by inclusion of a trademark, logo or name of the advertiser, or the word “advertisement”. The Texas Thoroughbred expressly reserves the right to not publish any advertisement which, in the opinion of the Publisher, is inappropriate.
  8. Insertion orders are binding on the advertiser at issue closing date and may not be canceled thereafter, but The Texas Thoroughbred reserves the unrestricted right to reject any advertising at any time. Failure by The Texas Thoroughbred to publish advertising matter invalidates the insertion order for such matter, but shall not constitute a breach of contract nor affect any earned discount.
  9. Publisher has the right to hold advertiser agency jointly and severally liable for such moneys as are due and payable to the publisher for advertising which advertiser or its agent ordered and which was published.
  10. Publisher shall be entitled to payment from advertiser and agency for any and all collection and litigation costs incurred by publisher, including but not limited to reasonable attorney’s fees and court costs.
